Shortly after midnight on January 24, 2005, Bollinger was stopped on Interstate 10 by two Sutton County Sheriffs deputies for speeding. The deputies asked their dispatcher to check Bollingers license plate and drivers license numbers and the drivers license number of Bollingers passenger. The dispatcher reported that the passenger had an outstanding warrant, and he was taken into custody. No outstanding warrant was reported for Bollinger. The deputies searched the passenger compartment of Bollingers car and found a marihuana pipe in the right door panel on the passengers side. Bollingers passenger admitted that the pipe was his.
